These Terms of Service ("Terms") govern your use of the Blooms Fresh website and your purchase of products through our online store. The website is operated by Blooms Fresh ("Blooms Fresh", "we", "us" or "our").

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse or cancel an order where reasonably necessary, including where a product is unavailable, a pricing or listing error has occurred, or an order appears to be fraudulent or unauthorized.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled portion of the order.

3. Prices and Taxes

Unless otherwise stated, prices displayed on our website are in Canadian dollars.

Prices and promotions may change from time to time. Any applicable taxes, shipping charges or other fees will be displayed during the checkout process where applicable.

We reserve the right to correct pricing errors and, where permitted by law, to cancel an order that was placed based on an obvious pricing error. If your payment has already been processed, we will provide a refund for the affected order or item.

4. Orders

When you place an order through our website, you are making an offer to purchase the selected products.

After placing an order, you may receive an order confirmation by email. An order confirmation does not necessarily mean that your order has been accepted. We reserve the right to accept or decline an order.

We may refuse or cancel an order where reasonably necessary, including where:

  • The requested product is unavailable;

  • There is an error in the product description or price;

  • We suspect fraud or unauthorized activity;

  • The order appears to be intended for unauthorized resale or distribution; or

  • We are unable to fulfill the order for another legitimate reason.

If we cancel an order, we will notify you and refund any amount that has been charged for the cancelled order.

Payment must be made using one of the payment methods offered at checkout.

Payments may be processed by Shopify and/or third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided.

We do not generally store complete payment card information on our own systems. Payment information may be handled by the applicable payment processor in accordance with its own terms and privacy policy.

6. Shipping and Delivery

Shipping and delivery information, including available shipping methods, estimated delivery times and applicable charges, will be provided during the ordering or checkout process where available.

Delivery dates and times are estimates and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by circumstances beyond our reasonable control, including carrier delays, weather, transportation disruptions, labour disruptions, customs delays or other events beyond our control.

You are responsible for providing accurate shipping and contact information. We are not responsible for delays or additional costs resulting from incorrect or incomplete information provided by you.

7. Returns, Refunds and Exchanges

Returns, refunds and exchanges are subject to our applicable return or refund policy.

Nothing in these Terms limits or excludes any rights or remedies you may have under applicable consumer protection legislation.
